Uncertainty in the European Patent System - The EPO’s Concept of Priority and Its Implications for Applicants
Abstract
As applicants become more strategic in their use of the patent system, an increasing number of applications claiming the priority of an earlier application and divisional applications are filed. Changes in the implementation of the priority system may encourage applicants to work and publish their inventions earlier, to the advantage of both the applicants and the public.
